UD vs. Konami Lawsuit

I heard about this story on the radio a couple of nights ago - not sure what has happened with the decision but it apparently has some sweeping ramifications regarding all sports leagues and the way the conduct external and internal business. Could certainly pertain to the subject at hand.

Worthy of note, people are saying McWilliam plead the fifth, but if you check the court documents, that’s not true. He did give testimony.

You can give testimony and still plead the 5th. In fact, pleading the 5th must occur on the record. He likely answered many questions, except for those critical to the issue of the unlicensed cards.

People are pleading the 5th because Copyright infringement in both a criminal and civil offense. Anything that gets into the official court record can then be admitted against them in a subsequent criminal case for copyright infringement.
 
I was hoping to have someone at the courthouse today, but don't think that's worked out. I'm in touch with the NY Post to get an update as soon as they hear.
 
So today is the trial as to how much will UD pay Konami....how long will this take, few hours, days, etc?

Correct... I thought today was a judgement day, but it's the start of the trial where the court will determine, based on evidence, the level of damages UD will have to pay. Could be a day, could be a month. Who knows.
 
The trial starts today and Konami has 15 witnesses on their list with 14 other names as potential witnesses.

Not sure how long the trial will take but it certainly won't be over in a couple of days unless the parties settle.

I bet UD is wishing they had your lawyers right now....at least what you did, you were careful not to break the NHL trademark barriers.

I don't think who the attorney here is matters. What happened here is a classic case of the client doing whatever the client wants. No amount of hand-holding by the attorney could have prevented this. In fact, I would say that a great amount of effort was expended to prevent the attorneys from finding out. As a business and entertainment attorney I cannot think of a single instance when I would give a client the advice of "sure, go ahead and print some stuff in China and not tell the rights owner. I'm sure the money saved will be worth it in end."
 
I never understood Yu-Gi-O, never will. This lawsuit will get settled. Money solves everything. I just like the fact that McWilliams was mentioned in the article shreading the evidence, lol.

I wonder if the NHL will be watching this? I know Dr. P and ITG will watch this carefully.

Moral of this lawsuit, dont bite the hand that feeds.

Called it 20 days ago. If UD can pay this setlement off by March, then the settlement is not much at all.
