Am I being scammed?

I just got this email from a relatively new eBayer that bought my two Ovechkin MVP RCs.

Q: HI I received the two Ovechkin MVP Rookie cards in the mail today. I am unhappy with the condition of the cards. They both have black lines across the front of them. One has the black line across the top near the shoulders and the other has a significant black line across the front at the level of the upper deck logo. What can we do about this? I do not want to give you bad feedback but I will if we cannot come to some sort of agreement about this. Thanks James

I sent the cards in seperate soft sleeves inside seperate toploaders inside the same teambag inside a bubble envelope. The cards were in excellent condition when I mailed them out. This customer did not purchase the optional insurance which would have been hideously expensive to Canada. What are my options?
  • Do I tell him to screw? I already have a negative on eBay so I don't care about the pristine feedback anymore. I have positive feedback from some recent high-end transactions that speak a bit louder than this idiot.
  • Do I ask for a scan to see this so called damage?
  • Do I stop being intolerant of everybody? (not a real option)
  • Do I give this idiot a partial refund?
  • Do I ask for the cards back and give a complete refund, even though I offer insurance, state that all sales are final, and absolve myself of any and all damage that may arise in transit?
As each day passes, I hate people more and more. I will try to avoid going postal. :)

And if anybody wants to know who this idiot is and his address so you can avoid dealing with him email me and I will give you all the information you desire.

I would ask for a scan to see this damage. Also make sure the card is not in a toploader because he can make a line of that. IMO I wouldn't give this person anything. Probably just making it up to get his money back.
 
I might believe him had he said ONE of them had a line, but to claim both have this mysteriously appearing black line scream scam.
Dont give him the time of day let alone a refund.
 
Would you reply with this:

Please scan the cards (outside the toploaders and soft sleeves to make sure you are not seeing something on those) so I can see what you are referring to. The cards were sent in excellent condition, well protected in soft sleeves, top loaders and a team bag then shipped in a bubble envelope. There should have been no damage to the cards. Please note that I offered insurance for these cards and to inquire for rates. You opted to not utilize that service. I also state that I am not responsible for loss or damage to the cards. And please remember that even though I state quite clearly that all sales are final, I will try to work with you. Let's just make sure the cards themselves are damaged and you are not seeing something on the protectors.
 
A solid e-mail except for the closer. I would recommend removing everything including and after the sentence starting with "And please remember..."

A lot of my career negotiations are of similar intent, and there is no need to show weakness. I suspect he is gonna slap you with a neg. regardless, so don't lose the money too.

Just remind him of everything you offered to protect him, get the scans, and see what wording he comes back with. Any kind of profanity or "in-your-face" response typically indicates deceit. If he comes back with clear scans and a showing of being willing to negotiate, you can go from there.

Hope it works out for you bud.
 
I would reply if there was something wrong with the cards. Just hard to believe that both of them had black marks. Glenn makes alot of valid points. I would go with that.
 
I'm with Glenn on this one. His response was a perfect one IMO.

You have to hear the guy out. Obviously you wouldn't give him a blind refund. Ask for scans...if he refuses you know why. Maybe even call him on his own bluff and say you'll refund him if he returns the cards. I've had a similar problem with a buyer who claimed damage...I made that offer and never got the cards back and the person stopped emailing.

since it was only for $12.50 I would try and settle rather then get a neg feedback. I would pay $6.25 to avoid a neg feedback.
 
Thanks, Steve. Upon further review of my images I have of these cards and of the other rookies from this set, they all seem to have some varying degree of severity with the line going across the card. How should I respond to his next email that follows?
Q: I will try to scan both cards tomorrow when I get to a scanner. How do I send you the scan? Both cards have the black line across the front. It is not on the plastic cover or sheet. That's the first thing I checked. The fact that I didn't get shipping insurance is irrelevant as this did not happen on shipping. It likely came out of the pack this way but you did not disclose the damage to the cards in your ads. Thanks
Should I reply with a tough cookies type response? Like this:

There was a scan provided in the auction showing the cards. I reviewed my auction image and there is apparently a line going across the card. I did not see this damage on the card when I pulled them and packed them. I also checked the other rookies pulled from those boxes and they appear to have varying degrees of this line. This appears to be something inherent to these cards. The scan does show it in the auction image. You bid on the card seeing the image.

Or should I reply in a different way?

I can't give him any type of refund at this time. My situation ****s royal butt. I am willing to send some sort of compensatory card(s) but I won't offer that to him right away. And if he feels like giving me the neg, so be it. In my current status I just don't give a "you know."
 
Definatly ask for a scan of this damage, if he can't prove it, he's out to get you! Then go from there depending what he does in response.
 
If the scan in your auction clearly showed the lines, you have to come good for the auction. Anyway you look at it the seller is always responsible to provide a satisfactory product. In my own view thats what I would want to do myself. Saying oh well let him give me a negative is just not right when you are in the wrong, sorry Oscar but I don't think you have any choice but to refund his money.
My 2 cents, ignore as needed.

Can you send him auction links to other similar MVP rc's that show the same lines?

I would point out the lines in the auction nicely and throw the ball back in his court. Ask him why he bid on them knowing that lines were in the picture, or something to that effect.

See what he says. Communications are going decent so I would keep talking.
 
May I suggest:
1) Get him to email you scans. Never hurts to verify this stuff.
2) Offer him a refund for the cards - not his shipping charges - to be paid upon return of the cards to you.
3) Yeah, it stinks. Not much you can do.
 
Yes the lines are visible so he is entitled to a refund. If you missed seeing the lines & not mentioning it in your ad I say he's in the right. Ignore as needed.

Just to update y'all, I am negotiating with my buyer (notice I didn't call him an idiot this time) for a compensatory package of other RC's that I have available. We'll see where it goes. As much as I hate people, I still try to be nice.
Now to the people that insist on saying I am wrong. STOP IT! I have a degenerative eye desease that hinders my being able to see details like that. If I didn't maximize my scan of the cards and then take a magnifying glass to the rest in my possession I would have never seen it. Now I know to be a little more diligent in my examinations of my cards before I list them. When I have a card that is obviously damaged I note it so all are aware. Thank you all for your time and input.
