Ebay Seller

Well, the seller says pay asap BUT also says he will open a claim if a payment is not received within 2 days. He's contradicting himself big time, and therefore you should have the claim for the cards after you would have paid.

The seller should just bite the bullet, and be more specific in his listings in the future.

What's wrong with you guys? Buyers can't make their own stipulations against ebay's policies. Just because they say "buyer must pay immediately" doesn't mean the buyer is obliged to sit at his computer and watch the seconds tick to make payment. I've looked at milansoccer1313's listings and while he does say "immediate payment required" he never provides an actual time or date when the break is to occur and he also says that the break will be posted once all payment is made.

IMO payment within 24hrs is more than reasonable, and according to ebay you have 48hrs to make payment (and milansoccer1313 acknowledges this in his listings.) I can't imagine that 31/31 buyers paid immediately. It just doesn't happen on auctions, even if they are for box breaks. And who posts breaks when at least 4/31 spots haven't been paid for and then keeps the hits for himself? Oh, that's right... scammers. I'd steer way clear of this guy's box breaks. If he's willing to do this, who knows what other stunts he's willing to pull.

Hit the seller with a Negative and warn others about his scummy tactics.

FYI, ebay can't really do anything anyways. I'd call them just in case there are defects on your account from this transaction which ebay should remove.

What timestamp is on your bid cancellation VS what timestamp is on the break video?

If your bid was cancelled before the break, logic would imply you would not be entitled to the hits. If the bid was cancelled after the break, theres issue on the seller's end either with how he's organizing these breaks or integrity wise

Bids were cancelled within 8 hours after the break.

No one can force the seller to ship a card. Take breaks out of the equation and if you won an auction for an amazing price, and the seller cancelled the transaction, there is no ebay claim that could force a seller to ship the card. I'm not even sure what type of claim you can open to dispute this? A claim is to get your money back if you didn't get what you paid for...ive never heard of a 'force seller to ship' claim?

From that seller's auction description:

"Please pay immediately after purchasing your spot(s). Be courteous of others waiting for the break. If you can’t pay immediately please do not buy a spot. If you do not pay within 2 days of purchase I will open an EBay case against you. This will prevent delays and once the final spot is bought and paid for please check back here to see the name of the videos to look up on YouTube for this box break."

Clearly he is attempting to cover his asset with the conflicting terms.
On one hand he says 'Pay Immediately" and on the other he says that he will open a case if not paid within 24 hours.

And yes - technically the seller IS ABSOLUTELY supposed to complete any transaction that ends with a sale. And no you cannot hit them with a negative - because the transaction was cancelled.

The OP has every right to be pissed.
I would contact Ebay and complain - especially if the seller does it multiple times to others. The auction - presumably - ended at 10:50 pm (PST), that is 1:50 am to me and I would not be awake either.
