E-Bay /Patch Question

I got an auction win in the mail today - Hossa UD patch, problem is the card seems to have separated, ie the top half is bent up in the middle (not creased just warped) and has totally come away from the bottom. I don't think it's a shipment thing in terms of packaging, but maybe the glue gave out or something??

Anybody seen this before? Would you guys try to go back to the seller, or since it's a PC card in hand should I fight the Upper Deck fight? Thoughts?

All comments, suggestions appreciated.
 
Yes I have seen cards peel apart before too. I live in TX so the immense heat during the summer can have an adverse affect on the glue. Not sure why it would happen during this time of season. If it is from the 05-06 UD then I would try to return it to UD. They will be able to replace it, but you may be talking 2-3 months with renumbering and everything. Good luck with whatever you do.
 
Forgot another couple of questions:

When I've e-mailed UD in the past about damage they state to return the packaging - but I didn't open this, should I bust a pack and send the empty pack in as well just to be safe?

Also have some other damaged cards (Artifacts base, and another patch with a factory crease where the patch goes in). Is it better to send all in together or 3 different packages?

Send them all in together. Make sure you make a detailed list of what you send in (card numbers, serial numbers, ect.) Also, if possible, keep scans of the cards and send them in with delivery confirmation. I sent in a package with a bunch of stuff and after 6 months they don't know what happened to it. Because I was able to provide all of the info, I was taken care of very well.
