Ebay Advice Needed..

Welp, I have a problem I've never run into. I won an item off the bay on August 9th. Monday rolls around (15 days after winning the item) and I contact the seller to see if he had shipped. He tells me it was received the 13th and gave me the delivery confirmation. Sure enough, USPS.com says it was delivered. But I don't have the card. So after a short back and forth with the seller and a call to the PO, basically the card is lost and something needs to be done.

My question is: as the buyer in the situation, am I left to pray that he compensates me? If he pulls the "well it says it's delivered, how do I know you're not lying?" route, do I have any recourse? Nothing has been done yet by the seller aside from his expressing frustration with the P.O.

Any feedback is appreciated.
 
You need to get something in writing from the post office that says that they lost it. Then HE needs to refund your money and file for insurance collection.

Ah but there lies the problem. Seller didn't get insurance and the P.O. basically said we're SOL.
 
Can he prove that it's your delivery confirmation #? Is there something on the USPS website that shows the delivery address? If so, I'd fight the PO on this one. Otherwise the burden is upon the seller to prove otherwise.

The PO determined it was the right #. UGH I wanted my card because, at the price I paid, I think I got a good deal out of it.
 
I believe paypal rules state that the seller has to prove delivery with
a signature.

Also, the post office delivery confirmation form is not official to
my knowledge, it does not satisfy paypal rules.

you should be able to file a paypal claim.

I don't want to be a jerk about it, you know? He's been good in communication and hasn't given me the 'ol "well it says you got it, so tough ****" yet. *sigh*

A signature is only needed if the sale price is over $250.00. If he has delivery confirmation from the PO proving delivery, even if the PO screwed up, I'm not sure what would happen. Any chance of checking with a neighbour to see if they got it by mistake, or if it got left by the door?

I'd imagine if a neighbor got it, they'd have returned it as we're on pretty good terms with our neighbors. Nothing by the door but I suppose I can double-check again to be safe.

He came back and said he'd refund half the price as a good gesture, I asked if it were possible to just refund the card (excluding the shipping) as there's basically nothing I can do here except cross my fingers and hope.
