Ebay Issue - Damaged Card

So I received an SP Authentic Rookie Limited Patch Auto off Ebay the other day. As soon as I opened the bubble mailer I saw the damage on the right side of the card (pictured below) and emailed the seller about the damage.

The seller responded that the card was as listed, pulled from pack to sleeve to plastic and that I don't grade cards. When I said that the damage should have been listed in the auction description the seller went on to say that the he does not grade cards, I should have asked about the card, the card was never listed as mint and that he did not even look at the card as it was the Devils.

I find this completely unacceptable and am really ticked off about this. The seller told me he that it is my fault for not asking about the card.
The card has a nice patch on it, but if I knew about the damage I would not have bid as much as I did for it. I will be leaving negative feedback, but I just wanted to vent here as this was the second damaged card I received in as many days that did not have the damage disclosed in the auction.

He didnt look at the card because it was a devil..... thats pretty sad excuse. sadly i think ebay would side with the seller on this one because he never said it was mint. sorry
 
So the seller can tell you about every single break, colour and stitch on the card but he can't see the giant chip at the top of it? I call BS.

And just because you don't grade cards doesn't mean you can't spot damage. You're not asking him to give you a rating out of 10.

Anyways, eBay's return policy is that you HAVE to give a very detailed description if you are not to accept returns. In this case, the detail was NOT enclosed. I don't see how eBay can side with the seller.
 
The seller should have still listed the damage, whether it was damaged by UD or not...
Plus the seller did not provide a good picture of the card, I can post his pic up later

I messaged the seller telling him it was negligent to not describe damage to the card in his auction and he said, "like the auction ad said, pulled from pack, went to magnetic holder, maybe you should have asked before you bid. report this matter to ebay if you want, see what they have to say. if you were concerned about the grade of the card you should have enquired as others did."

Not all of them had this damage. My case hits were fine but my individual box break had the damage. I sent in my Seguin and it's been months now. Since it's a hard sign card, perhaps getting it replaced will take some time.

Yet he knew it was a Tedenby but I thought he didn't look at the card....

Funny, I just got done listing an Anders Lindback that had this problem, as did all of my FWA patches. I made it VERY clear that this problem was present, also pointing out that it can be seen in the scan. Shame this seller is being problematic. UD mangled this set this year.
 
I say get eBay involved and, if you paid with one, get your CC involved. There is no way you could know the card was like that from the description or photo. Not everyone is as educated a collector as some of those of us that are hardcore, though, so I wouldn't think it your responsibility to know these were all jacked up by UD. Now, if you were aware of the issue with these cards from the factory by seeing other cards that way, I think you should have asked to make sure on this one, too.

Well how is it his fault? The seller didn't provide information about the damage and his picture was not good enough to tell, Kinda sounds like the sellers fault if you ask me..

If the seller did his job as per ebay guidelines it would be irrelelvant. Do some reading an you'll find ebay requires sellers to accurately describe the item and to provide information if there's issues which cannot be seen from the listing and/or pictures. The seller of this auction did neither. Yes, buyers should ask questions on some things but this is a very blatant issue that should have been disclosed.


This case is easy - file the claim and hammer his *** with a negative for being another useless ebayer. He knew full well it was damaged and just tried to slip it by.
 
He did not even look at the card?? Funny how he is able to then describe the patch pretty accurately: "Nice 3 color 3 seam limited auto patch. red/red seam/black/black seam/white/white seam/red". I guess someone told him in detail what the patch looks like. :rolleyes:

if the seller is going to sell a card, it's also his job for FULL disclosure. if he can describe all the selling points of the card, he can disclose all the imperfections as well.

anything being sold (let alone cards) are expected to be mint, NOT damaged.
if the seller doesn't disclose damage, buyer assumes mint. --OK
if the seller doesn't disclose mint, buyer assumes damage? --NOT OK

if the seller didn't want to disclose the damage specifically, that's what the term "AS IS" is used for.

i can understand where you're coming from but if you don't want to fix the problem, then there's no use complaining about it. otherwise, putting "rant" would be more appropriate. honestly though, i would think you have a case if you wanted to get your money back. just make sure to return with delivery confirmation if you do.
