Help with eBay issue

Hi all.I would like some input on the following issue i have with a current eBay purchase.It would be nice to have input from both buyers and sellers on eBay i know some of you do both
I won a card on April 24 2009 at 23:31 EDT , i paid the following day on the 25th via paypal.I had not received by the 11th of May(i live in Calgary seller lives in Ontario i figured 17 days was enough time for card to arrive province to province)
I emailed the seller and asked if he had shipped the card yet here is the reply
i have copy pasted from his email on the 11th of May.
" Hey, I was just going to msg everyone i sent stuff to that day, i got it all back in the mail because the lady at the post office miss post marked all of them, sorry for the inconvenience. "
Ok the card does not arrive today.
First question how much longer do i wait before should be concerned or take action ?
Second question if card comes Tuesday or Wednesday what kind of feedback do i leave. (neither of us has left feedback yet)
Third question i hope it does not come to this , how you file a paypal dispute
and is there a time limited on how many days after purchase to take action.
All i really want is the card not a big hassle but you do what you have to.

There is a limited time on where you can file, I would file and just explain to the seller that you are wanting to protect yourself. If you dont continue the action then it wont affect the seller in anyway.
 
Joel, paypal gives you up to 45 days to file a dispute. You should be receiving a message from eBay today with a new system that will be starting June 8th.

"The biggest change to the agreement is the addition of a new policy -- eBay Purchase Protection -- borrowed almost directly from the existing PayPal Buyer Protection policy. In essence, eBay is now going to run the purchase protection program instead of requiring buyers to go to PayPal."

If you go to your messages and look under "Related Links" you should be able to report an item not received. You can also go through paypal and click on Security Centre (at the bottom of the page), and then on Resolution Centre.

You've still got lots of time, I'd wait a bit and see if the card comes.
 
File with paypal (45 days to do this) and file with ebay that you have not received. Even if seller states that items were returned because of mistake that very well could be what happened as things happen. I had a seller ask me to wait past the time limit and then responed oh well you should have filed a complaint.
 
My personal policy is to wait a month before I file.

Should people work more quickly? Yes they should.

Does the seller deserve fewer that 5 stars when it does show up? Yes he/she does.

But it doesn't hurt you to wait a few extra days, and maybe the person is telling the truth. Give people the benefit of the doubt, show some patience, and you live a lot happier, in my books.
 
What's the feedback on the seller? If he's reputable then I wouldn't worry about it.....if he's got low or crappy feedbacks I'd file thru paypal just incase. Let the guy know you're going to file so you don't miss the deadline if he's legit then let him know he has nothing to worry about.
 
Go ahead and start your claim NOW for an item not received. It will still take about 2 weeks to complete the process, so if the card arrives, you can always cancel the dispute.
