Need help with an eBay issue

Well, this is the 2nd time this has happened to me. I found a card listed on eBay that I already bought last year. The card never did show up, and the seller and I agreed to split the cost, so he sent back 1/2 of my payment. I just found the same card for sale on eBay. The seller is one of the big stores, with over 25,000 feedback, so my guess is that he's selling it for someone else. The original seller has 100% feedback, and is still selling. To be honest, I don't have concerns about him, or the new seller. I think someone intercepted the card, waited until they thought it was safe, and is now trying to sell the card through a major eBay store. So my question is who do I contact? I don't want the listing to get pulled prematurely, and I can't be 100% sure about the sellers (although I'll say again, I don't think they have any knowledge of the situation). I think filing a report for stolen property would be blindsiding the current seller. Do I have to open a case in the resolution center?

If it was a year ago there is nothing that you can do. Ebay wont do anything about it. It just looks like you have to take your loss and move on.

I figure that may be what will happen, but what message is that sending to dishonest people that intercept our cards. Do they just have to wait a couple of months and then throw these cards back on the Bay with no consequences. It's not about the money, I just don't like to see someone benefit from ripping off someone's card.

That's a lot of assumptions.

You should contact the current seller and present your concerns openly and see if he'll divulge as to how he came into possession of that card. Based on his response you'll know whether it's worth bringing up with eBay's Resolution Center.

Yes, I just did that. I also sent a message to the original seller so that he can contact the current seller as well. Can you even open a case for this if it is older than 45 days?

I would still report regardless of age. If you used paypal you will have transaction records going back that far.

There is no way that I'd just let it ride. Someone out there is dishonest and now you've got them backed into a corner. Maybe the store owner has no idea but I guarantee the guy that originally sold it to you does. Just my own opinion but I hate being ripped off too.

Original seller probably thought you got too good of a deal on the original sale. So they thought they'd hang on to it for a bit.....then try to re-sell it thru their 2nd ebay ID, or their buddy who also has an ebay account.
Dont let this go without a bit of a fight. Garbage like this happens all to often on the Bay IMO.

Since you already paid half of the card, i would win it back, chargeback for the full amount when you receive it, it should cover the interest.

Even if it's too late for ebay to do anything concrete about it, I'd still pursue the info about the person who currently owns the card. Perhaps if multiple claims surface about that person, it'll establish a pattern which will make it more likely something can be done about him/her. Consider posting identifying info about him/her on the Board, to better focus the spotlight. All this assumes you'll determine the current owner is indeed a thief.

While it is a matter of principal, I would still base my course of action on the amount I lost on the card. Is it worth my time and effort to pursue it. Obviously the answer will differ for everyone.

Thanks for your thoughts everyone. Communication is continuing, which is a start at least. After talking to the current owner I am convinced he has done nothing wrong, and the original owner seems committed to tracking down the history of this card. So, will we get far with this? Probably not, but I feel better for at least trying.
