Paypal Chargebacks

Accept my apologies if this has been addressed countless times, but here's my very abridged version.

I live in the states and sold a $15 item through the 'bay up to Canada...obviously didn't charge the Registered mail fee to the buyer (he wouldn't have bid in the first place if shipping costed more than the item). Fast forward one month, he claims item not received and remits a chargeback thru Paypal. I have my USPS stamped customs form confirming that I sent the item...but of course do not have a delivery confirmation type receipt, since registered mail costs in the range of $15. Do I have any rights as a seller?

I don't want to refund the purchase price...seems unfair for me to take a total loss when I shipped out the cards! Plus, I still believe there's a good chance it hasn't worked its way completely thru the postal system, and delivery may be only 1-2 weeks away. Has anybody been in this jam before and used the "Escalate claim to Paypal" option? Just curious if I should have any hope at this point. Seems like I could be at the mercy of buyers when shipping across the border without using registered mail in situations like these in which the item closing price is less than $50 and it just doesn't make sense to register it.

I've seen a lot of auctions where sellers give the buyer the option to either use First Class Mail or Registered Mail, so seemingly the responsibility would fall on the buyer if the item were lost in the mail. That being said, I still think feebay would side with the buyer in that case, since it seems like the fairness scale is so far weighted in favor of the buyer that it can be detrimental to the seller.

If you've been through a situation like this, can you share your 2 cents? Thanks!
 
Sorry my friend, you're screwed. I was ripped off by a buyer who got me and (at least) 8 others (confirmed by email) for about $1000 in cards that he claimed didnt arrive within 1 week. I had reciept and stamped customs forms, emails from 8 people all sent to paypal. The user either unregistered from or was kicked off ebay, and paypal STILL didn't refund our money. Its only happend 3-4 times in over 900 ebay transaction, but you just have to cut you losses, fight it as long as you can, and hope your buyer is honest and drops his claim when his item arrives.

No proof of DELIVERY, no refund :(
 
Abridged version - you lose on this one. While it sometimes does take longer than 30 days for items to get there - Paypal buyers have the right to make a claim , and will win without any type of delivery confirmation.

One last thing to try - enter your customs code into the canadapost.com system. Sometimes they do show up - whereas they do not in usps.com.

This is part of being a seller - taking the risk that items get lost in the postal void.
It does not mean that every buyer is a scam artist.
 
Unfortunately I have to agree with Suitamn19..Only way to prevent a buyer from doing this is with tracking.
This does stink since of course a 15.00 item is not worth paying over 10.00 in tracking charges.

I suppose one idea is to state the fee for tracking is required..and use a trading site to promote your auction stating that users with x feedback don't pay the fee....not sure how well that works but it could.
 
Thanks for the tips guys. I never assume the worst with these scenarios, but I just wish you could track using a customs form. This is only the 2nd time this has happened to me in like 250 transactions, so I guess it's just a cost of enjoying the hobby. Going forward I may just implement a floor above which insurance is mandatory...say like $50.
 
I have one suggestion - contact the buyer and offer to split the loss. As a buyer and seller both, I have had reasonable success with this approach. Nobody bears the full loss.

I have done this both with success and failure but it is worth a try - it is always worth having the discussion. I had one buyer who said that because he could see that I had shipped the card that I didn't have to refund the shipping charge - at least you save a little bit and proves that there are some decent people out there.

As mentioned by everyone above, this is one of the risks of shipping outside of the US without delivery confirmation. Good luck to ya.
