Small Ebay Issue

hey everyone, I have a small ebay issue I am dealing with right now. I bought a Brodeur Premier Signings /15 from a guy about 3 weeks ago.

Package Arrived yesterday, I opened it, and it had Luc Robitaille Premier Signings /15 inside.

I e-mailed the seller and informed him that I recieved the wrong card, which is no biggie it could happen right?

well he gets back to me saying he has a lot of stuff going on right now in his " head " and he hasnt been right as of late......im starting to think this is getting strange.

he told me he mixed up the packages, another buyer recieved my Brodeur....

then went on to say that he wants me to mail it back first-class and once he recieves it he will issue a refund.

so I got to thinking, he never asked me if I still wanted to Brodeur ( i should mention that i scoop it up pretty cheap ) he just asked me to mail the Robitaille back and he'd issue a refund.

If I send this card back I have absolutely no guarentee that he'll issue refund. wouldnt the proper thing to do , since this was his mistake. issue a full refund and i'll take the chew and mail it back at my expense?

what do you think i should do?

This may sound too simple to work, but see if he can help you contact the one who got the brodeur and just do the trade between the two of you...
 
I agree with your proposal Mike. Sounds strange he wouldn't offer to try and get the Brodeur back and send it to you...what's his ebay rating?
 
Do not send it back or you will be out your cash and a card. If he does not agree to refund you, file an item not as described case. If you do send back first, make sure it has tracking.
 
I guess it depends on his eBay rating in my mind. Is he reputable or rather new on eBay? It's strange that he didn't mention anything about trying to get the Brodeur back for you, so I also have warning bells in my head, even without knowing the details.

But I had this sort of thing happen to me once as a seller, and in addition to paying for the fellow to return it to me with tracking, threw in a free 'nice' card to both parties when everything was re-sent properly. It happens (but hopefully only once!) The main questions here for me, other than his eBay ratings, is more about if he's willing to go out of his way to make this right? And you shouldn't be out any cash for return shipping, especially since I agree tracking is critical here. If it doesn't feel right, I'd do as Terry suggested to be safe. Good sellers who make mistakes will go out of their way to make it right. Shady sellers, not so much.

Regardless of how you proceed, card must be returned to sender (with tracking) before refund need be issued as per Paypal rules.

True, but if you get PayPal involved you stand a chance at getting your funds back.
