I don't think that's the consensus... for me, I want them to pay for their mistakes. They owned up to them (to a point - some pleaded the 5th) and they settled out of course for whatever $$ they did.

I don't think the majority here want UD bankrupt... I think we want them to WORK for our hobby dollars... a shared hockey license would do that. I'm just not sure if they can handle the MLB lawsuit on top of the Konami one.

you got all the receipts evidencing your puchases of yu-gi-oh? did walmart and target even get the fake yugioh batches?
 
at the local card shop today the owner was saying his distributor was "strongly" advising him to get his UD Baseball orders in ASAP as he fears they(UD) will be locking him(distributor) out of that product due to the liscencing issues at hand.i saw first hand the new UD Ultimate Baseball product and can say that they make no obvious attempt to conceal MLB's logos or names whatsoever.first thing i thought of was how strict the NHLPA is with Dr.Price and how frustrating it must be for him to abide by their rules,yet UD literally is laughing in the face of MLB and the MLBPA.brass balls on them for sure.
 
Did anyone ever consider that the MLBPA is supporting this new endeavor?

Perhaps they want to test the courts to determine if UD needs an MLB license to make these cards. If UD wins with MLBPA's support, then only one license is required and MLBPA can up their royalty rate.

Just a thought.

perhaps,it would be a slick move on their part.then they would cut out the teams owners of all profit gained.however,you know better than anyone that outside of headshots the powers that be would be all over both parties with hands out(or lawyers)for their fair shake.and trust me,MLB owners make NHL owners look like choir boys in comparison.second only to NFL owners,they are the sole inspiration for The Who's "Silus Stingy".man i'm showing my age there:laugh:

I can't imagine the PA doing that. Pushing the league's buttons like that is just going to cause more separation and make things worse for the players amid what is already a structure that has many teams in financial trouble and a league mired in controversy due to its players' inability to play clean.
 
It was just a thought but I know that all the cards have to be approved by the MLBPA as part of UD's license with them.

I they didn't support this, they would not approve the images with MLB logos on them.

Again, just a thought.

It's definitely an interesting theory Brian.

UD has responded in a letter to its dealers. B_ckett obtained a copy of the letter and put it, or at least portions thereof, on their site.

I read that letter , and it sounded like Pacific did the same thing about 10 years ago and walked away scott free . If Upper Deck goes , i guess that will be the end of my collecting days. With all do respect to Mr. Price , and everything he has done , i just dont find that product appealing in any way for myself. Well i agree UD has gotten lazy , IMO they still put out the superior products , and have done alot for the collecting world as well.

No not at all im done because of the complete nose-in-the-air arogance being shown. THEY were in the wrong and they are spinning it back on Konami. NOTHING is ever their fault.:rolleyes:

Surely there must be a clause in there somewhere regarding the company needing to be in a good standing or at the very least a clause regarding reputation. If (as i have read it so far) UD have been confirmed as having knowingly soldand distributed fakes then as a body (NHK,NHLPA ect) I would not want my bran associated with theirs.

I am glad as collectors we have ITG and an alternative route for collecting. I wish the folks in charge could see for example how well H&P as been recieved this year, its seems everyone (exept me grrrr) is getting into the stuff this year

Whatever language is in the exclusive is virtually a moot point now, since it's about half a year from expiry and late-season sets like BAP have already been announced and area likely well into production. All that it will be is strikes against UD as negotiations fully open towards next year's licensing.

The license expires apparently June 30th. Negotiations are already well underway, if not almost done.

I'm trying to recall contract law, but if i remember correctly contracts cannot be legally negotiated while a current contract is still in effect. Discussions and consultations might be happening, but any official negotiations cannot take place until after expiry, save for renewals. I remember there being a sh*t storm about this a couple years back in the NHL
