what should i do? ebay situation

well i bought around $20 worth of man made packs from a seller around the 25th of September and still haven't received the cards, and i sent him a message a week ago and didn't receive a reply,

now i went to ebay just now to send him another message and cant find his account...

should i wait a little longer? or would you guys file a charge back?

and if u think i should file a charge back, how do i do it? cause ive never had to do it before
 
I think you're getting close to your PayPal time limit of 45 days (I think that is the limit) so probably worth opening the claim...they have to reply to you and PayPal with the tracking/ signature proof and if they didn't send it that way, then if he has the money in his account it will be given back to you.

Where was it coming from? You're over a month now, so pretty much anywhere it should be to you by now...

Put it this way if it were me, I'd be opening my PayPal claim...
 
With the information you have provided - I would be in with Kev and would most likely be starting the paypal process.

Border shipments seem to be extra slow lately (which always seems to be the case when the Canadian dollar and US dollar get closer in value) and I have seen a couple of packages from Canada to the US take around a month so its possible that it could be on its way but you only have 45 days to get your claim in. It doesn't hurt to start that process anyway.
 
I'll add that when I do open a claim as a buyer, I'm always very polite - not confrontational. I explain that since whatever-it-is hasn't arrived yet I need to start the claim process as I only have 45 days from payment. Sometimes the seller is totally fine and those are the sellers that you know will work with you. If they get all pissy and start going off the deep end, well, I don't feel as bad.

Still, go about it right and it'll all work out!

I've had only one transaction where I waited for the card for about 40 days then filed my paypal claim to ensure I had it filed before the 45 day paypal deadline. I've now got until early November before escalating it into an actual claim that I want paypal to investigate and deal with. I'm doing nothing until that November date on the off chance I receive the card in the mail, but it's doubtful since all the other things I've purchased around the same time, have long since been received. In my experience things coming to Canada from the States usually take at most 3 weeks to arrive but if you want to be sure, give it a month and if nothing, then it's likely a problem deal. So I agree with the others that you should file the claim and do so before you miss any deadline. Check on the paypal website and it'll tell you how their claim system works.

Before filing any claim, you should contact the seller to let him/her know what's going on and verify (for example) the date the packet was sent out, what method was used (ie. regular mail?) and what address was specified on the outside of the packet. Perhaps you're unable to do this if the seller's account has been pulled.

Best of luck dealing with this one and I hope you manage to get your packs eventually (or a full refund), but the seller no longer having an ebay account is certainly troubling.
 
I would have to agree with Kev on this one as well. I have had to open claims several times and most times the people are very polite when you explain why to them. That being said though, I have had a couple that started berating me in email but once I got my product or money back I just ignored them afterwards. You must remember to always cover yourself as the sellers always will as well. And him not being on Ebay anymore is very troubling but I think Paypal would still have the link to his bank account or credit card to give you your refund if it ends up going that far. Good luck.
