Nice job guys (you UD guys I mean). I trust your legal department has been closely involved with the wording used on all communications. For example, admission of fault must be carefully presented to ensure that future charges of misrepresentation cannot be brought down? Right? ;)

Hmmmm. I would like to know when this decision was truly made. A speculator may suggest this was known prior to the Toronto Expo (since big machines take a long time to change directions).

I think the company is borderline abusive with the redemption program. Hopefully no collectors have experienced stress over this to the point of health issues ;) And hopefully nobody will be put under financial stress if their redemption portfolio were to become suddenly worthless.

Of course since I have only Draft Redemption issues, I speak merely hypothetically :cool:

Just like what Jay said, this is exactly what they are banking on with everyone who they are just sending replacements without even telling anyone about it. Just remember it was your redemption card you purchased, you have every right to refuse the replacement if it doesn't meet your standards.

Interesting seeing someone saying phaneuf spa is being replaced, my stated shipped a week ago. I really hope this isnt the case.

The only thing that would meet my standards is having my Weiss Ice Scripts so where does that leave me. I won't be happy with anything they give me.

I can't complain bc i get my original RC auto redemption and some replacement but if i get double of what was expected, some won't get anything.

about NHL, i must say that some players are also responsible of that situation, guys like Nash, Sundin have a contract a deal with UD they must sign and do their job !

I know UD is big on not upsetting the players but you say its partially the players fault as well because they have a contract with upper deck and are paid by them. Everyone here will agree saying its not all upper decks fault but they will also say its upper decks fault to continue to use these horrible signers year after year. They know including nash, kovalchuk and sundin in checklists will sell more product regardless if its an in pack auto or a redemption that will never be redeemed. It's just an illusion and they refuse to stray away from that. You screw up doing something at work sooner or later your fired or not asked to do specific tasks, in UD's case they just love piling it on and on and that's why people blame them before the players.

I'd like to think Upper Deck would realize that they can get a faster signing response from Terry Sawchuk than Alfredsson/Sundin/Kovalchuk. :D

Of course, that would mean they'd have to know who Sawchuk is in the first place. :rolleyes:
 
Jay they know of a Sawchuk problem is it's a Tom Sawchuk he is the neighbor of alfredsson that is the guy helping getting Alfie's autos in exchange he gets an ovechkin rookie :D

First, let me say that I have only one outstanding redemption and it is not a big ticket item, as I have little luck in pulling them. It should also be noted that I have little love for Upper Deck's virtual monopoly in the NHL card area. I do have a few questions for the panel:

1. How will this affect the value of those redemptions of greater than 6 months old that have already been sent out? I mean are they going to be considered to be more rare?

2. Did the NHL lockout of 04-05 have a great impact on this?

3. Is this fraud under the legal definition?
OK this one I am looking up and according to Black's Law Dictionary 8th ed.

"A tort arisng from a knowing misrepresentation, concealment of material fact, or reckless misrepresentaion made to induce another to act to his or her detriment."

also under the definition of fraud in the inducement:
"Fraud occurring when a misrepresentation leads another to enter into a transaction with a false impression of the risks, duties, or obligations involved; an intentional misrepresentation of the material risk or duty reasonably relied on, thereby injuring the other party without vitiating the contract itself, esp. about a fact relating to the value."

With the above definitions perhaps the Better Business Bureau might also take an interest in what is occuring?
 
I contacted the Better Business Bureau and they are very interested in hearing from us.There was also a suggestion to contact the attorney generals office.Both are good ideas and the BBB should be the first one contacted.I am a bit surprized that with all the collecors on HI that at least one is not a lawyer that could add his proffesionial opinion on this.Are we all just beating a dead horse here.It is good to vent but if we can never achive results than we might as well stop.
I believe UD needs to bear a large portion of the responsibility.But these high paid hockey players are a lot to blame as well.If they are under contract to UD to sign cards,stickers or what ever.Than they are the ones that need to be made accountable first.Surely if they(players) did what they were suposed to do we would not have this problem.UD must have the cards made for the ones that require stickers.Send them out to the people thats sent in redemptions as bonus too their redemption replacement program.

Trust me Winston, no one likes to post on a forum the real story going on. There are lawyers contacted, letters are already written, contacts are loaded for a large group of people. It's more of a wait and see exactly how bad they screw over the collector this month. I think people will be surprised what happens over the next month or 2.
 
Well it's all a matetr of what shows up in the next few weeks also. Seems like some of the redemptions have started trickling in lately so I'm actually interested to see what people start getting.
 
I'll chime in briefly again... Winston, it's UD's contract with the players that they need to enforce, assuming there IS a contract. Technically it's a breach of contract, provided there's no "out clause" for the players.

Vinny is right... there is a lot going on behind the scenes. Should be an interesting month.

I spoke with a vendor at the market today after the show.

He'd contacted UD on a number of outstanding redemptions.... :eek: Anyways, a CS rep informed him that they are the midst of an inventory to determine 'Just Which Redemptions' they have in stock. ;)

This inventory should as he was told finish in around the end of Feb. His question to the CS rep, 'Then at that time outstanding redemptions will be sent out?' Too which the CS rep replied in a vague roundabout manner... No, they are just seein' what they have in hand... :rolleyes:

Bruce - There's a matter of opinion involved in some of the disputes. One of the players claims that what he's being asked to sign falls outside of the terms stipulated in his contract. Others are simply protesting the "one buyer" market. Irrespective, it's a gong show.

UD is starting by figuring out what they have in hand and how it can be committed with maximum effectiveness. For example, let's say that there are three guys on a Five or Six star autograph that haven't signed. One of them returns his stickers - is there any point in committing his autographs to the Multiply Signed card when it's unlikely that the other autographs won't be forthcoming? Those are the kinds of questions they need to answer before they get too far into this.

Make no mistake, this attempt to rectify the redemption fiasco is a massive undertaking. Joe Fallon and Karvin Cheung are both personally involved and heavily committed to the project - and this is an aspect of production with which they should NOT have to get involved. That they are involved speaks to the seriousness of the situation.
 
Agreed, Steve... and trust me, I'm glad Karvin's involved. Only known him for about two weeks, but what I know I like. He's a diligent guy and I believe really has the collectors' needs at heart. I'm just not sure he's going to win this battle, given the severity of the situation and how out-of-control it is. Guess we'll see what happens.
