Right, he should not be held responsible for the plastic case which was broken during shipment. But, he should be held resposible for selling a card that was creased BEFORE the item was purchased, and not putting it in the description.

Ok, hypothetically speaking. The buyer is only requesting a refund due to the damage caused by shipping. He circled the damaged areas, and they are EXACTLY the same as in the original scan, only the case was damaged, and the buyer noted the only damage being the 2 small stress creases. So basically his claim that the item was "not recieved as presented" is BS right?

Just think deeply into this, not whether or not I listed it any way, the fact that he is arguing it was not recieved in the same condition as it was described, which in fact, creases or no creases, it is EXACTLY the same.

Then we can move onto issues like whether or not he wanted insurance/registered mail, or the main fact of why he bid if he was unsure based on just a scan and no description.

I listed the card and felt I did not need to list that as "damage". Not only is that common for those types of cards, it was COMPLETELY visible in the HIGH RESOLUTION scans.

I rest my case, anyone who cannot see these points needs to wipe their monitor clean, how I should be held accountable as the seller is ridiculous. I did not force the bidder to bid on my auction...period.

Wow, why are you asking for opinions then? Everyone has stated their opinions, with solid reasons, and you have said "No, everyone else is wrong" without giving any really, solid reason. Makes me glad I don't buy basketball.

I dont undestand why I didnt give any solid reasons why I said anyone was wrong? I just am trying to prove points that seem to be overlooked, no need to get angry or anything, you dont have to post here, I just wanted opinions, and I got them, if your the type of person who cant budge on a decision then thats fine I have no problem with that, but its just a lot of people who I have asked about this problem and have sided with the bidder have said the same thing, their reason is that I didnt list the creases in the description, but that, in fact, is irrelevant to my original question! The issue wasnt over if I listed the "damage" or not, it was the fact that I was being forced to give a refund due to the item not recieved as described, when in fact, there is undisputable evidence, even given by the buyer, that the item was recieved in the same condition it was described in, and that description was for the buyer to assume using the scan I provided, since I do not feel "stress creases" are considered damage to a card.

The point is, as you may or may not have read earlier in this post by dherm, that the seller's reason for filing the claim has no weight to it. Since the scan he gives is identical to the original scan I provided in the auction other than the damaged case of the card. And the auction was for the card, not the case, so therefore, in my opinion, it seems the seller was unhappy with the price he paid for the card, so instead of dealing with his overzealous bidding habits, he decided to damage the case, circle the exact areas that were already visible in my original scan, and say that the item was damaged in transit and not as described in my auction. However, he decided not to pay for registered mail for the card, and did not ask me beforehand about the condition of the card if he had any questions, which he had every opportunity to do so before pressing the "Bid Now" button.

You are right, the card arrived exactly as it was before shipping. But I'm sure the seller didn't know it had creases and assumed it was damaged with the case during shipping.

Personally I think you are right, the card looks the same as yyou sent it, you posted what the card looked like. I believe you are not responsible for the buyers lack of viewing the cards defects. I would suggest though in future auctions that you place see card image for condition somewhere in the auction. Then you know for sure that it is there.
