Sup guys, I recently sold a fellow my Honorable Numbers Joe Thornton 19/19 auto patch card.

I held it for him, agreed to pay for shipping and insurance to Canada from the states. He bought the card for $275. I held the card for 2 weeks waiting for him to pay, and he did on time. I insured for $300.00 and sent through the USPS.

I sent the card, went out of town. I get back into town and he says he didnt receive it. I get the card returned in the mail?!?! No idea why...so he opens a claim with paypal, I have to resend and defend myself. So I use UPS this time, insured for $300.00.

About 5 days go past, I check the status, and its goofy. It says its being held blah blah blah. I get an email from him demanding $80.00 for C.O.D. charges. $40 or so for Provincial Tax, and $40.00 for a UPS brokerage fee clearing customs.

I am pissed at this point, but I contacted UPS, Customs, and emailed him, as well as Paypal. Paypal says you don't have to pay. I explain to them I don't like to be extorted. Anyways...I email him, and let him know I am willing to pay $40.00 of the $80.00, but I'm not paying his tax. He is the one who insisted on it being insured, and I let him know Paypal said he is responsible, as I had paid for shipping and insurance.

The guy agrees, even though he's mad. I acknowledge this transaction hasn't gone smoothly.

Today...Man I am P.O.ed...I get an email that says this:

Our agreement was for the purchase of "Joe Thornton, 05-06 UD The Cup
Honourable Numbers, numbered 19/19. Not the UD 05-06 base card that you
sent!

He is now claiming I sent him a BASE card!!!!!!!!!!!!!!!!!!!!!!!

I have already replied to him, and send a major defense to Paypal explaining he's trying to keep the card I sold him and get refunded by Paypal/Me.

What can I do??? I asked him to tell me what the card came wrapped in, since there was something specific in the off change someone did swap the card out. It was labeled Hockey Card and INsured for $300.00.

His name is Jeff Guarascia...I wanted peoples opinions before I plaster his name on Beckett.
 
Personally, at this point, I would be contacting the RCMP and see what you can do about laying theft and fraud charges on this clown. Did he specify how it was to be sent? If he was a stupid enough twit to agree to UPS in the first place, he deserves everything that is coming to him. Taxes and brokerage fees are not your responsibility, they're his. You completely fulfilled your end of the bargain by sending it to him insured and it got to him safely.

But in the future if you're sending a high $ card - send it either by USPS Registered or FedEx. UPS' brokerage fees are incredibly usurious for the amount of disservice they provide to Canada.
 
Wow that sucks because all he has to do to get his money back is file an 'item not as described' claim with PP and send the card back to you with tracking. If he does that- I am sure that PP will find in his favor. Wow -talk about a turn around vs sellers sending empty envelopes with tracking to rip off their buyers.

Good luck with this and you'll have to keep us updated.

PS: I buy a fair bit of product from Dave and Adams and they ship DHL to Canada and as long as they put the value I suggest on the package - the cost is VERY reasonable with very little Brokerage fees.
 
If you both agreed that you would ship USPS then I think you covering half of the fees is fair because UPS shipping wasn't agreed upon but if there was no agreement made about how you would ship then I wouldn't have given him a penny. On a more serious note, I have a feeling the scumbag is going to get his money returned because he is saying you sent him a base card. He is going to get his money back but instead of sending you the Thornton back he is going to send you a base card back. Best of luck to you with this situation.
 
I'd call Paypal immediately and explain the situation BEFORE he files his claim. They should have a record of your last complaint on this clown anyway. Plus, did he not e-mail you asking for all those fees and taxes back? At the time he did that, had he not already opened the package? If you had sent him a base card he would have told you that day, not a few days later...

I'd have to agree with the above. If in fact this was the case of 'Jeff' already being in possesion of the package and requesting that you help pay the UPS & CRA fees.

Hopefully you'll be able to have this turnout in your favour?

You probably should not have marked the value as $275.00 on the customs slip. I would be pissed if I were the buyer, too. Obviously you do not know how to ship outside the US.

You can insure packages going to Canada - you automatically get a certain amount with Registerd mail based on the weight and you can add on more if you like - you can also add insurance on to a Global Priority package.

Also - its pretty tough to claim something is worth $10 and then insure it for $300 - also pretty illegal.

So, you'd want to get back at him by filing a bogus claim? He did what the buyer asked him to do. If he's pissed, it's his own fault
 
Insurance never works outside of the country, because the package is only marked as being delivered to customs. The post office has no proof of delivery to the actual resident. Good luck proving that point gamebreakers.

I've actually claimed a lost package to the US before and got my full refund so you need not enlighten us on "how to ship outside the country". It seems you always play devil's advocate on these boards with ZERO to back it up... And, when going to USPS or Canada Post's website and entering the tracking number, it indeed DOES tell you when the package has been delivered to the recipient.
 
From Canada to the US they aren't too many options for a sig required without it costing like $30 I think - just ridiculous amount anyway.

Even within Canada - to ExpressPost it - if you want a sig -it is an extra $1.50 on top of the 10-12 they already are charging. Better to send it registered for the $8.00 plus postage and that way you get the sig as well but it can only be up to a hundred bucks value I think.
 
If he has to send you the card back (registered, so there is proof of delivery), say the envelope was empty. Two can play that game :) The guy sound like a total D-bag.
 
Not that I want to fuel any flames, but for international insurance options - I like Auctiva. It's a great alternative to all the work required by the USPS to insure a package going to Canada. Costs are lower, and you can actually make money using it.

I don't know how it would work from Canada back, but Auctiva's been excellent to me as an eBay seller.

If insurance wasn't available, you wouldn't have the option to pay for it Rob.

As for Graeme's position... this sucks. This guy is obviously out to screw you on this and hopefully your paypal complaint earlier was kept on file so you can show this guy's a bonehead.
